Christine Leanne Calderon v City of Menifee
Plaintiff filed a lawsuit against Defendants Heritage Lake Master Association and Firstservice Residential California, LLC (Defendants). Plaintiff also sued the City of Menifee. Plaintiff was injured on a sidewalk which was public property. Despite this, she still sued Heritage Lake Master Association and Firstservice Residential California, LLC and claimed that said defendants managed and controlled the property. Defendants filed a Motion for Summary Judgment (MSJ) as they did not own or manage the public property. Prior to the hearing for MSJ, plaintiff dismissed Firstservice Residential California, LLC.
The Court granted the MSJ in favor of Heritage Lake Master Association.
