Halliburton v. Stadium Properties (Second Appellate District)
Lauren Lofton obtained a tremendous appellate victory in the Second District Court of Appeals upholding her previous defense verdict.
The plaintiff, Julie Halliburton, claimed that the contents of her storage unit were unlawfully sold in a forced lien sale by Stadium Properties, LLC.
At the trial, in April 2017, the jury returned a verdict in favor of Stadium Properties, based on plaintiff’s repeated failure to timely pay her storage fees or stop the lien sale of her property. Plaintiff appealed the jury verdict, asserting that Stadium Properties violated various statutory requirements when it conducted the sale. T
he Second District Court of Appeal affirmed the jury verdict in favor of Stadium Properties. It determined that Stadium Properties’ lien enforcement policies were consistent with the California Self-Service Storage Facilities Act and that there was no error in either instructions to the jury or the verdict form.
